A federal appeals court says a U.S. Border Patrol agent who fired across the border into Mexico and killed a teenager cannot be sued in U.S. courts by the Mexican teen's family.
The unanimous ruling was issued Friday by the full 5th U.S. Circuit Court of Appeals. The decision reverses most of an earlier 2-1 ruling by a three-judge panel of the court.
There is no dispute the agent, Jesus Mesa Jr., shot 15-year-old Sergio Hernandez. At issue is whether the teen's family could sue him in U.S. courts.
With support from the Mexican government, the boy's parents argued that the agent should be accountable in U.S. courts because his actions were on American soil. But the 5th Circuit ruled that, among other things, the agent was entitled to immunity.
