The Maverick County Sheriff's Department is facing a lawsuit by the family of a former prisoner, Noe Armando Hernandez, who according to Sheriff Tom Schmerber was arrested on August 22, 2013, taken into custody, began having a seizure, was taken to the Fort Duncan Regional Medical Center and subsequently died from an apparent overdose.

 

The lawsuit names the department, Sheriff Schmerber and three officers, Miguel Hernandez, Felipe Solis and Emmanuel Galindo in the wrongful death lawsuit.  The lawsuit was filed on March 26, 2015 at the US Federal Court Building in Del Rio and according to the civil action is for "monetary damages arising out of the  wrongful death of Noe Armando Gonzalez under the laws of the State of Texas and the laws of the United States of America and its Constitution."

Press Release

According to a press release from the Eagle Pass Independent School District allegations have led to the suspension of Charlie Ruiz. Ruiz is a Criminal Justice instructor at both Eagle Pass High School and at CC Winn High School. He is also a former police officer and a recent candidate for Justice of the Peace of Precinct 1.

Eagle Pass Independent School District Superintendent of Schools, Gilberto Gonzalez, released the following statement regarding the suspension of EPISD Employee Charlie Ruiz: "Mr. Ruiz has been placed on suspension with pay, based on allegations of misconduct.  Currently this is a matter being investigated by the Texas Department of Public Safety/Texas Rangers.”
