City closer to possibly purchasing (or condemning) property in downtown area

The City of Eagle Pass continues moving forward with the possibility of either purchasing or condemning a property in the downtown area which is to be turned

into a “pocket park”. 

City Council was presented a resolution seeking to ratify condemnation proceedings of the property, which is located in the downtown area.

The City Council moved forward with the resolution and its request.

The property - which will be eventually turned into a public park in furtherance of the City’s beautification process in the downtown area - is located on Main Street.

The resolution states that the municipality is endowed with the powers to exercise the right of eminent domain for public used to acquire public or private property, pursuant to Texas Local Government Code Section 251.001.

City Council has found that public necessity requires the City to acquire certain real property interest for public purposes, which was approved by a unanimous vote on June 5, 2018 to approve purchase and/or condemnation proceedings for the acquisition of 257 Main Street, as recommended by the Main Street Committee on May 9, 2018, and the Planning and Zoning Board on July 2, 2018 for the benefit and use of the public.

During the past months, the city has attempted to proceed forward with all options to acquire the property, but have had certain resistance from the property owners, who will more than likely seek counsel to remedy the situation and attempt to come to an amicable solution to the problem.
