The proposed amendment would create a new Article IV to regulate the transportation, storage, record keeping, and proper disposal of used and scrap tires; providing clarification of definitions; declaring the unapproved storage of used and scrap tires a public nuisance; establishing penalties for violations; the requirements of proper signage within establishments that sell new or used tires; establishing a disposal fee not to exceed $5.00.

The city has been working on this issue since 2017 when they proposed the ordinance.

During the past 18 months, the city has been ironing out numerous details in the ordinance to assure its enforceability and other issues related to the proposed ordinance and its changes.

The ordinance in question has been structured to address problems with illegal dumping of used and scrap tires throughout the entire community including the dangers created from unregulated stockpiles which in turn provide habitats for rodents, insects and other vermin including mosquito problems.

Mayor Cantu has stated in the past that it then puts a financial burden on the city. 

And that the proposed amendments are to establish regulations and procedures for safe transportation, storage, accurate record keeping, and proper disposal of used and scrap tires.

The amendments to the proposed ordinance include sections addressing approved storage methods, unapproved storage of tires declared a public nuisance, penalty for violations, exemptions, permits and records, authorized drivers and trucks among other provisions such as a charge for scrap tires at the places of business.

The Eagle Pass City Council approved the third and final reading of the proposed ordinance on a unanimous vote.

The City will begin a two month transition period in which they will notify the community, vendors and educate on the tire ordinance as well. The tire ordinance will go into effect on August 1, 2019.
