MCHD approves legal counsel service contract on a split vote

The Maverick County Hospital District Board of Trustees voted to extend their legal counsel’s services contract for two more years on a split three to one vote during a meeting held on Tuesday, October 30, 2018. 

   After discussing the item in executive session the Board reconvened back into open session. Board Member Ronald Hixson motioned to consider extending legal counsel Alex Fuller’s professional services contract for two more years.

   Board Member Jesus Casas intervened stating that he didn’t think the time was appropriate because Fuller still has a year and four months left in his current contract.

   Casas also opined that he felt that Hixson’s request was in some way politically motivated. “I don’t think we should be making that type of decision here today. Of course, we can. But extending his contract when his contract is not up until a year and 4 months from now just because we don’t know what’s going to happen next Tuesday (Election), I don’t think that is right,” said Casas. 

   Board Trustee Chuco Farias stated that the extension was in no way political and that Casas was going on a personal opinion. 

   “Nothing was mentioned about politics. His motion was based on  what he has done for the district, his ability and how much he is aware of what’s planned. It’s not out of the ordinary to extend contracts. You can do it at any time that you want to if you so desire as a board,” said Farias.

   Board President Adolfo Olivares intervened. “It’s not unusual for a board to consider extending someone’s contract.”

   Casas argued that the timing and perception would not look right to the community. 

   “Perhaps it may not look right to you. But we’re not looking at anything else but the work that the man has done,” answered Olivares. 

   Casas added that he did not disagree that Fuller was doing a good job but he would rather have the Board wait before taking such action. 

  MCHD Board President Adolfo Olivares proceeded to call the motion up for a vote and it was approved on a split vote. Board Member Becky Robinson was not present.  

   Mr. Casas proceeded to excuse himself and walked out of the meeting. 

   A month ago CEO Terri Patlan Contreras contract was up for renewal or termination and was extended for 3 years on a split vote as well. Robinson voted against stating that she did not agree with the way the process was being handled.    Casas was not present during that part of the meeting.
