Days after Texas Senator Carlos Uresti was found guilty on 11 federal charges, the Texas Democratic Party has asked for his resignation.

Although Uresti has received criticism from both sides of the aisle, he has stated that he has no immediate plans to step down from his position. Uresti has served 21 years in the State Legislature and is eligible for a pension which will be available for him even if he is finally convicted and serves time behind bars.
A felon cannot serve in the Texas Legislature, but Uresti can keep his seat while he appeals. This basically buys time and could take up to 2 years to clear up. This could leave him in the seat if he decides not to step down.
Uresti has been convicted of 11 Federal Crimes and will return to court in May to face other charges.
Senate colleagues do have an option to remove him before his term ends in 2020. Uresti has already been relieved of some of his senatorial duties by Gov. Dan Patrick. Under the Texas Constitution the House of Legislature is allowed to expel a member under a two thirds vote.
Up to now, local rumors have put State Representative Poncho Nevarez at the forefront to throw his name and run for the vacant position left once Uresti would resign or removed.
Nevarez has respectfully stated otherwise. “I think I’m happy doing what I’m doing now. The House presents challenges and I’m effective there. I think when and if I’m ready to make a move it will be because I can be of greater service. You always have to look at that,” said Nevarez .
