City approves first reading of flea market ordinance

The Eagle Pass City Council approved the first reading of an ordinance prohibiting the establishment of any new flea market operations within the city during their first meeting of 2018. The ordinance exempts those who may have a  conditional use permit in an industrial district.   

During the meeting city council discussed the issue in executive session, and once back in open session voted in favor of the first reading of this new portion of amendments to the flea market ordinance which will include a clause that will allow for a conditional use permit in an industrial area and an increase to the flea market operator fee going from $125 to $500 per year.The provisions will also limit the cease to operate period from 1 year to 90 days .    

The city council had previously approved another amendment to the ordinance in December to prohibit establishment of flea market operations in the central business district. This amendment will not allow for any other flea markets to open up in the downtown business district area, and grants permission to existing flea market operators to continue their operations. The ordinance however does state that if any of those existing flea market closes down, it cannot re-open at a later time.
