Reyes found not guilty of 2010 murder

Closing statements were heard by both sides in the murder case of Juan De Dios Hernandez by Timothy Johnson (Ret.) who was in District Judge Amado Abascal's stead due to Judge Abascal, who is recovering from an automobile accident. In a stunning verdict, a 12-man jury found Ruben Reyes, who was accused of the December 2010 murder of Juan De Dios Hernandez, not guilty after deliberations were heard by both the State and Reyes' defense attorney. In closing statements, the State presented the two charges facing the defendant; the first, that Reyes on or about May 2010 indeed did shoot Juan De Dios Hernandez twice in the head, the other was that on or about May 21st, 2010, Reyes did intend to cause bodily harm to Hernandez.

The evidence provided was that on May 21st, the last known contact was made with Hernandez by his mother. Additionally, where the remains were found, two cartridges from a 9 mm. handgun were found 18-24 inches from the remains, and that indeed, Reyes owns a 9 mm. handgun, and they produced a witness who stated that the two shots were fired from Reyes' gun. Another witness Aaron Saenz stated that Reyes shot Hernandez twice. There was also testimony from a Diego Dominguez who said that he was told by Reyes , "I killed him." The State represented by Assistant District Attorney Albert Rodriguez, closed by saying , " We must send a clear message to the community that this type of crime shall not be permitted." The defense counsel, Alberto Ramon addressed the jury by saying that he felt that this was indeed, "A very exciting trial." He added, "You saw photos of the crime scene presented by the State where a man WAS killed. You've heard both sides, there's no question that Mr. Hernandez was killed, the only thing is that there is a dispute whether Aaron Saenz' testimony is believable." Ramon also claimed that the two casings in question were planted at the scene and that there was no way that forensics officers could've overlooked them being there at the onset of the investigations claiming that with metal detector technology, they would've found them. He added that Reyes does own a 9 mm. weapon but the weapon in question was not purchased until August of 2010, two months after the murder and that the initial investigation was focused on three other individuals and not Ruben Reyes and in his opinion, the investigation was, "Faulty and full of holes." With this verdict, Reyes is acquitted on these charges and the question remains, who in fact did kill Juan De Dios Hernandez? It will be up to investigators to ascertain the answer to this question sometime in the future.
