According to sources, four of the five has pleaded guilty and only one Armando Nuncio has yet to do so. The others have said to have conspired to use the gas cards issued to city employees to pump gasoline for personal use and for personal gain. Elizabeth Vivian, Rene Castillo, David Hernandez and Edgar Aguilar, a former employee of Public Works, have all entered a plea of 'Guilty'. Another, Armando Nuncio has yet to declare culpability in the case and is awaiting his next hearing which could be sometime this month.
It was this summer that the Department of Justice indicted the five individuals. They along with others who have yet to be brought forth in this extensive investigation, collaborated to steal over $70,000.00 of fuel from the city with the use of two Gas Man cards which are issued to city employees to pump fuel for city vehicles. Sources say that multiple vehicles would line up on either side of one pump, scan the card and proceed to fill up car after car, truck after truck and SUV after SUV until in November, employees of an unnamed gasoline station noticed the erratic behavior and notified authorities seven months after the theft of fuel began back in May of 2011. The cards had in effect been at large since December of 2010, when a then employee of Public Works resigned turning in his city vehicle and his fuel card which was never turned in. Either one or more of the five already indicted would be the ones in charge of taking money from these individuals in cash for gasoline purchases sometimes discounted as much as 50% of prices which at the time hovered around $3.90 per gallon which means that at these prices, over 20,000 gallons must have been pumped illegally. Further arrests in this case are pending and may take place during the coming days. City administration is looking to recover the funds and get restitution for these crimes.
