Man arrested for terroristic threats released after court determines he did not violate parole

Rodolfo Banda has been released after having a parole violation hearing last week for an issue stemming from his arrest during the Maverick County $8.5 million certificate of obligation election.

 

Banda and over 20 witnesses had initially been interviewed in the past month by investigators and personnel from the Texas Parole Board after he had been accused of making terroristic threats to another person while campaigning at the early voting polling site (Maverick County Courthouse). 

 

Banda was released from the Tom Bowles Detention Center on Friday, June 16 after being incarcerated for approximately a month while waiting for a decision from the Texas Board of Pardons and Parole, which went trough all the informational testimony and evidence, and decided to set him free under the terms of his original conviction in which he served 20 years of a 99 year sentence before he was paroled a few years ago. 

 

Banda is required to follow the terms of his parole. If the terms are violated he could be put back into the Texas Penal system to serve out the remainder of his sentence: 79 years. 

On Tuesday May 2, the Eagle Pass Police Department, with the assistance of the Department of Public Safety, arrested 42-year-old Banda for a parole violation warrant. 

 

During that time a complaint was filed with the Eagle Pass Police Department for terroristic threats against him. The issue was compounded with Banda’s criminal history for a homicide which led to this arrest for possibly violating parole.  

 

 The parole warrant was affected without incident, and Banda was transported to the Eagle Pass Police Department where he was brought before a magistrate and remanded to the Tom Bowles Detention Center without bond waiting for an appearance of revocation determination before the Parole Board. 

 

It was determined that Banda did not break the terms of his parole.
