County taxpayer Ethelvina Felan will be taking place.
The scheduled meeting only has three agenda items, two of which are in executive session, including an item calling for the consultation of the commissioners court with their legal counsel on matters regarding Ethelvina Felan v. Maverick County.
At the same time, a hearing on the second floor of the courthouse is scheduled to take place over Maverick County’s heated debacle with taxpayer Ethelvina Felan over the Maverick County 2016 adopted tax rate.
Felan filed a state district lawsuit on February 21, 2017 in the 293rd in which District Judge Cynthia Muniz then voluntarily recused herself on February 24, 2017.
A judge was then chosen to replace Muniz, and both parties proceeded to court where District Judge W. C. Kirkendall then denied a request from the plaintiff for a temporary injunction that would stop Maverick County from collecting ad valorem taxes.
A review of the case file shows that Maverick County has recently filed a plea to the jurisdiction motion for summary judgment on May 3, 2017 .
Felan’s attorneys filed a similar motion after and will now go in front of the judge with testimony, and possibly get a summary judgment or denial from the visiting judge.
If the judge does deny the parties’ petitions the case could possibly continue to trial.
