Muniz’s formal letter states, “Comes now, the presiding judge of the 293rd Judicial District Court and voluntarily recuses herself from the above styled and numbered cause pending in Maverick County, Texas and for such issues this order is referring said cause to the office of the presiding Judge of the Fourth Administrative Judicial Region of Texas.”
The case will now have a visiting judge appointed, to review the legal complaint that Herrera has filed against Maverick County in the form of a Writ of Mandamus on May 2, 2017.
Herrera, through legal representation, filed a Writ of Mandamus Petition at the Maverick County District Court against Maverick County as a governmental entity to compel the release of public information which he had requested under a Texas Public Information Act back in 2016; information that Herrera states has not been handed over to him despite orders from the attorney general which instructed that Herrera should be given the information by the County.
