Judge Muniz recuses herself in petition filed by taxpayer Ethelvina Felan against the County

293rd District Judge Cynthia Muniz recused herself from the recent petition filed by Ethelvina Felan v.  Maverick County David Saucedo in his official capacity as Maverick County Judge and against all the Maverick County Commissioners Court in their individual official capacities and also against T. Roy Schmerber in his capacity as Maverick County Elections Administrator 

 

A legal document from the 293rd Judicial District Court submitted by Judge Muniz on February 24, 2017 states that the Judge of the 293rd Judicial District Court voluntarily recuses herself from the above styled and numbered cause pending in Maverick County, Texas and for such issues referring said cause to the Presiding Judge of the fourth Administrative Judicial Region of Texas (AJR). 

 

The issue that Muniz is referring and recusing herself from is a plaintiff’s original petition for writ of mandamus, permanent injunction and declaratory judgment and request for disclosure filed on February 21,2017 by Felan and her attorney Jose Garza.

 

 The original petition Cause  alleges that the county officials went beyond one's legal power or authority. The petition also consists of a declaratory judgment compelling the county officials perform their duties as described by law. 

 

The document goes on to describe in detail the set of actions that supposedly were taken by the county officials that has led to the issue.

 

 

The AJR’s presiding Judge is the honorable David Peeples who was originally appointed by the Governor in April 1996.
