Details Given in Heredia Case Led to Bail Being Denied Featured

As officials, bailiffs, court reporters and security began to file in to the US District Court Western District of Texas Courtroom, County Commissioner Rudy Heredia was sitting with three other Federal detainees awaiting their due process. The tension was high as government counsel prepared their case against the elected official who will be arraigned on four counts: conspiracy to commit money laundering, aiding and abetting money laundering, conspiracy to commit bulk cash smuggling and aiding and abetting bulk cash smuggling stemming from the sale of a 2005 Ford F-250 King Ranch pickup truck to possible members of an organized crime syndicate in Piedras Negras, Coahuila sometime between 2009 and 2012 when FBI agents were monitoring Heredia's phone via wiretaps which have since been contested by his attorney John Convery of San Antonio.

Amidst heavy security a group of interested onlookers and 12 family members, deliberations began in the pre-trial arraignment which uncovered serious accusations which in fact do not appear in the indictment such as the alleged misappropriation of TxDoT funds, the delivery of checks for County projects to his residence, the alleged use of heavy machinery belonging to Maverick County on private projects, his participation in an alleged kickback scheme and alleged sex crimes committed across the border all made on the basis of FBI wiretaps and FBI transcripts of conversations from these investigations. After hearing this testimony from Jarett Doss, FBI agent, Convery was quick to point out that besides the wiretaps which counsel was unable to get a copy of, there was no substantial evidence against his client in reference to these accusations which in his opinion were out to "Assassinate his character." When US Magistrate Judge Collis White heard all the evidence in this proceeding, he allowed both men's attorneys to formally request bails to which both were denied due to , in David Gelacio's case, a risk of flight to Mexico, and in Heredia's case, he did not happen to feel that he was a flight risk, yet due to the fact that federal prosecutors have evidence of his relationships with known criminals, his bail was also denied pending arraignment, the discovery phase of pre-trial deliberations and a date on the court docket for the actual trial. Attempts were made to contact County Judge David Saucedo for comments with respect to the situation of having to replace Heredia temporarily on Commissioner's Court and what the procedure is in reference to the receipt of funds for County projects, however no official comments were given by press time. A preliminary hearing for Jose Luis Aguilar will be held tomorrow to determine his eligibility to post bail due to a lack of counsel on Tuesday.
