A highly compelling civil case was heard before The Honorable Amado Abascal, 293rd District Judge on Thursday where unofficial reports indicate a decision was handed down favorably for the plaintiffs in the case of Claudia Davila and Adrian Davila v. local physician Carlos Hernandez, M.D.
The details of the petition filed March 24, 2014 cite an October 16, 2012 incident where Mrs. Davila was admitted to Fort Duncan Regional Medical Center for what is described as a "total laparoscopic hysterectomy".
The information provided within the petition states that the doctor during the surgery may have accidentally "sheared a 3 cm Koh plastic cup leaving an unintended foreign object in Mrs. Davila's (body)."
Dr. Hernandez was represented by Claudio Heredia of Eagle Pass and Richard Woolsey of Corpus Chisti. Representing the Davilas was Tyler Scheuerman of San Antonio.
"This was a medical malpractice case which dealt with a hysterectomy," stated Scheuerman in a phone interview on Friday, "The plaintiff indicated there was a problem with the surgery and the verdict was in the amount of $319,000.00 to reasonably and adequately compensate the plaintiff for her injuries."
