Chavez not sentenced; Hearing tabled

The Eagle Pass News Gram was in Del Rio on Wednesday at the sentencing hearing for Hector Daniel Chavez before The Honorable Alia Moses, US Judge Western District of Texas.

Chavez' family were present in the courtroom as well along with prosecutors, US Marshals assistants and court reporters/stenographers at Court Room #1 at the US Federal Court building.

Judge Moses arrived at 2:25 PM and took to cases prior to Chavez'.

The hearing began at 2:45 PM and Judge Moses asked both attorneys to approach the bench. For the US it was Bruce Thomas and representing Mr. Chavez was Silvia Ann Cavazos. As they approached the noise-gate which is used to allow all parties to have a private conversation was initiated and at 2:53, Judge Moses took yet another two cases to allow Cavazos to consult with her client where they retired to the far end of the court room to possibly discuss sentencing guidelines and details from her pervious eight minute conversation with the judge.

Chavez did not seem to be in agreement with what his legal counsel was explaining to him.

At 3:15 the sentencing phase began once more and after clarifying her stance on the sentencing guidelines, Judge Moses asked the defendant if he understood to which he replied, "Yes. your honor."

When the guidelines were read a restitution of $138,411.18 was included for 18 checks he had allegedly forged and for six projects totaling approximately 76,000.00 to which he clarified that in fact the six projects which his company had completed were paid for by Maverick County.

This caused yet another 12 minute delay as both attorneys approached the bench.

When all was said and done, the sentencing was tabled for a later date which was not available at press time.
