The news came down from the office of the District Attorney's Office on Friday, July 2nd from the 365th Judicial District Court of Maverick County, Texas. In this case Martha Zamarripa and Elisa Martinez former clerks in the office of the Justice of the Peace were also indicted on the same charges stemming from incidents over a one year period which were well documented and presented as evidence in the trial phase beginning on or about August 20, 2007 to on or about October 3, 2008. In non-accomplice testimony provided by the DA's office stated that then Auditor Carlos Pereda had discovered that certain transactions which were conducted without the use of what are referred to as Pro-Com receipts showed no payments corresponding to hand written receipts issued by the office. A discrepancy of tens of thousands of dollars were noticed in two fifteen month periods where the former JP collected approximately $484,000, but when the appellant took office, the collections for the first nine months amounted to only $85,519 and for his first full fiscal year, he collected only $172,714- approximately $260,000 over a twenty month period, significantly less than the prior justice of the peace.

Former Justice of the Peace of Precinct 2 Cesar Perez took his case to the 4th Circuit Court of Appeals where The Honorable Sandee Bryan Marion presided and The Honorable Karen Angelini and The Honorable Patricia O. Alvarez also sat in on the case where in two issues on appeal, appellant asserted the evidence is insufficient to (1) corroborate the accomplice witness testimony, and (2) sustain the conviction and the justices affirmed the court's ruling of guilty of aggregated theft of property valued between $1,500 and $20,000.00 by a public servant pursuant to one scheme of continuing course of conduct and the trial court assessed punishment at eight years' confinement probated.
