$281,000,000 judgement handed down in Dimmit County wrongful death case

In one of the first cases of wrongful death in relation to companies from The Eagle Ford Shale Project, a Dimmit County jury returned a verdict in favor of Clarissa Aguilar, the sole surviving parent of Carlos Aguilar of Laredo who was killed tragically when a drive shaft broke off an Eagle Ford truck and crashed through the window killing Aguilar. The size of the verdict and the local concern regarding increased truck traffic in the region has commanded not only regional, but statewide and national media interest.

According to the petition made by attorney Ronald Rodriguez, the victim was a passenger seat of a pick-up truck traveling westbound on FM 133 when the driveshaft assembly on a Heckmann 18-wheeler broke off from the tractor-trailer, bounced off the opposite side of the road, crashing through the windshield striking Aguilar in the face and neck, causing catastrophic injuries. Engineers have determined that the object, a twenty pound driveshaft traveling at over 55 MPH with 20 tons of force per square inch, or 40,000 Lbs. of force per square inch which left his family without a father. "The driveshaft is held together by U-joints, which if not properly lubricated, they start to create heat then they break off and injure people," stated Rodriguez in an exclusive interview with The Eagle Pass News Gram, "I'm proud to have obtained one of the largest verdicts in the history of Texas and a full measure of justice for my clients. The verdict will make the road safer throughout South Texas and the families within the Eagle Ford Shale."
