La orden judicial exige que la directiva y la Administración de EPISD cumplan con el proceso y hayan convocado elecciones para el puesto a pesar de que tenía el derecho por ley de ocuparlo con el nombramiento de Lisboa.
Lo que se argumenta es que la Junta también tenía la responsabilidad de someter el escaño a votación en las próximas elecciones disponibles, que serían las elecciones presidenciales de noviembre.
El simple hecho es que hay al menos dos leyes que se superponen y que deben aclararse.
Esta semana, el caso Díaz llegó a la sala del juez de distrito Amado Abascal, donde ambas partes presentaron su información y argumentos sobre el tema.
Durante ese tiempo, el abogado de EPISD solicitó tiempo suficiente para preparar una declaración de defensa relacionada con el nombramiento y las leyes aplicables a la decisión de no convocar una elección para ese puesto.
El juez Abascal concedió el tiempo y desde entonces ha recibido cierta información.
Aunque aún no se ha presentado ninguna orden oficial, se informó al EPISD que deben convocar una elección especial para el puesto 5 que actualmente ocupa Libson, quien tendrá que decidir si buscará la elección para este puesto. Esta elección es más que probable en el mes de mayo.
Lo que viene a continuación es que EPISD buscará más información o instrucciones del Secretario de Estado de Texas sobre el asunto y, de ser necesario, convocará a elecciones especiales bajo los términos aplicables según las disposiciones del Código Electoral de Texas.
El Distrito Escolar Independiente de Eagle Pass se reserva el derecho de apelar cualquier decisión u orden otorgada por el tribunal de justicia.
El Superintendente Samuel Mijares informó que están a la espera de mayor información y orientación por parte del asesor legal del distrito y, de ser necesario, con gusto realizarán una elección para el Lugar No. 5 plazas.
EPISD Advised to Call Special Election for Place 5 Seat by District Judge Abascal

The Eagle Pass Independent School District Board of Trustees named Morris Libson Jr. to the seat left vacant by Lupita Fuentes due to her passing in April of this year and a call for it to not be put up for election has come into question, ending up in the 365th District Court under a Writ of Mandamus filed by Enriqueta Diaz.
The writ of mandamus calls for the EPISD Board and Administration to fulfill the process and to have called an election for the seat even though it had the right by law to fill it with the Lisbon appointment.
What is being argued is that the Board also had the responsibility to put the seat up for vote at the next available election, which would be in the November Presidential Election.
The simple fact is that there are at least 2 laws that overlap each other that must be cleared up.
This week, the Diaz case made its way to District Judge Amado Abascal's Courtroom where both sides presented their information and arguments as to the issue.
During that time the EPISD attorney requested for ample time to prepare a defense statement related to the appointment and laws applicable to the decision to not call an election for that position.
Judge Abascal granted the time and has since received certain information.
Although no official order has yet been filed, the EPISD is reported to have been advised that they must call a special election for the Place 5 seat which is now filled by Libson who will have to decide if he will seek election to this seat. This election is more than likely in the month of May.
What comes next is that the EPISD will seek further information or instructions from the Texas Secretary of State on the matter and, if needed, will call the special election under terms applicable as per the provisions of the Texas Election Code.
The Eagle Pass Independent School District has the option to appeal any decisions or orders provided by the court of law.
Superintendent Samuel Mijares informed that they are waiting for further information and guidance by the district's legal counsel and, if required to, will gladly hold an election for the Place No. 5 seat.
