Rearraignment hearings set for Heredia, Aguilar, Moncada

According to sources close to the Western District of Texas, rearraignment hearings for Suspended County Commissioner Rodolfo Bainet Heredia, Jose Luis Aguilar and Juan Carlos Moncada have been set for March 12 at 9:00 A.M. before The Honorable Judge Alia Moses in Del Rio.

Heredia, who faces charges of conspiracy to launder money, aiding and abetting money laundering and conspiracy to smuggle bulk cash into the US, has been in federal custody since October and has requested to be released on bail twice.  The Honorable Magistrate Judge Collis White has denied those two requests.  Heredia is being represented by Evelyn McNamara.

Jose Luis Aguilar, who is also under federal custody for the same charges will also likely plead at the hearing before Judge Moses as well.  His counsel is also Evelyn McNamara.

Juan Carlos Moncada, who is facing charges of fraud by wire and converts to own property of another theft concerning programs receiving federal funds, will also be present at the hearing.  Moncada however, was allowed to post bail and is free on bond at this time.  He is being represented by James G. Nowlin.

In a re-arraignment hearing there is usually a plea involved according to Daryl Fields, Public Affairs Officer for the US Attorney's Office, Western District of Texas.  What usually follows is what is known as a precedence report with the judge which outlines details in the case which will help the judge make the appropriate sentence and usually takes 30 to 60 days.
